Crimen Injuria - Vicki Momberg

- Featured article by LAWYERS-ONLINE.CO.ZA - April 2018

In 2016 we saw Vicki Momberg lash out racial slurs on a video that went viral. This at police officials who tried to help her after she was victim to a smash-and-grab incident. She was heard saying the K-word 48 times and disrespectfully rejected assistance from black officials.

The Vicki Momberg case has been a sore point in our newly democratic South Africa. The country has followed the case with close anticipation and finally nears its end.

Vicki Momberg was found guilty on four counts of crimen injuria and sentenced to an effective two years in prison. The court sentenced her to three years, with one year suspended. One year was suspended for a period of three years on the condition that she did not repeat the offence.

At a previous sitting a prosecutor told that Momberg's was the worst crimen injuria case the courts have dealt with. The courts conclude that the k-word was used in all its intent and that Vicki Momberg has shown no remorse for her crime.

However, it was countered that Vicki Momberg should be sent for rehabilitation instead of direct imprisonment, as she was not in her right mind after just having been the victim of a smash-and-grab incident.

The courts disagree, and South Africa will see its first jail conviction for crimen injuria.
