The Mother Who Faked Her Infant’s Kidnapping Gets Sentenced (Interesting Case)

- Featured article by LAWYERS-ONLINE.CO.ZA - February 2018

Early last year more than one-hundred cops came together in search of the kidnapped infant girl. Private security firms, the general public and social media all came together in the pursuit for her safe return. The baby’s mother reported that her infant was kidnapped from the Durban city centre and so started the large scale search.

However, two days after the ordeal was reported, the girl was found in a car at the Marianhill Toll Plaza with a man now known to be the baby’s biological father and the mother’s lover.

The woman pleaded guilty to charges of fraud, defeating the administration of justice and making a false statement. On 24 January 2018 the mother of the baby was sentenced to five years jail time, of which she would have to serve at least ten months. The magistrate concluded that the mother needed to understand that what she had done is wrong.

It is now understood that the woman gave her baby to the man with whom she was found voluntarily. He was also charged and is due back in court February 2018.

Custody is a complex element and even where biological parents are involved, these matters can easily take a turn in the wrong direction. It is wise to consult a child custody lawyer with any potential concern. Our child custody lawyers on lawyers-online can assist.
